Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Lullaville app ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App.

These Terms apply to all users, including parents or guardians who create accounts and set up child profiles within the App.

2. Who May Use Lullaville

Lullaville accounts may only be created by individuals who are 18 years of age or older. By creating an account, you confirm that you are at least 18 years old and, if creating profiles for children, that you are the parent or legal guardian of those children.

Children under 13 may not create their own accounts. Child profiles are managed within a parent or guardian's account.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at lullavilleapp@gmail.com if you suspect unauthorized access.

You agree to provide accurate information when creating your account and to keep that information up to date. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Billing

Free Tier

The free tier includes 3 stories per month, 2 child profiles, English and Spanish language support, and no audio narration. Free-tier stories expire after 7 days.

Premium Tier

Premium subscriptions are offered at $4.99/month or $39.99/year, with a 7-day free trial for new subscribers. Free trial available only if you have never subscribed to Lullaville Premium before. Premium includes unlimited stories, 4 child profiles, all supported languages, audio narration, and stories that never expire.

Billing

Subscriptions are billed through your Apple App Store or Google Play account. Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current billing period. To cancel, manage your subscription through your device's App Store or Play Store settings.

Refunds

Refund requests are handled by Apple or Google according to their respective refund policies. Lullaville does not process refunds directly.

Free Trial

If you start a free trial, you will not be charged until the trial period ends. You may cancel at any time during the trial to avoid being billed.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse engineer, decompile, or extract the App's source code
• Use automated tools to scrape, crawl, or generate content in bulk
• Impersonate another person or create accounts for unauthorized purposes
• Submit content or child profile information intended to generate harmful, offensive, or inappropriate stories
• Interfere with or disrupt the App's servers or networks

6. Content Generated by the App

Stories are generated using artificial intelligence based on the child profile and preferences you provide. While we design our prompts to produce age-appropriate, positive bedtime content, AI-generated text may occasionally be imperfect.

You retain no exclusive rights over generated stories — the same prompt inputs could produce similar stories for other users. Generated stories are provided for your personal, non-commercial use only and may not be resold, republished, or distributed.

You are responsible for ensuring the story settings and child profile information you provide are appropriate.

7. Intellectual Property

The Lullaville name, logo, app design, and all original content within the App (excluding AI-generated story text) are the property of Lullaville and are protected by intellectual property laws. You may not copy, reproduce, or use any of these without our prior written permission.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated stories will meet any particular standard of quality.

To the fullest extent permitted by law, Lullaville disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Lullaville shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email. Your continued use of the App after updated Terms are posted constitutes your acceptance of those changes.

11. Termination

You may stop using the App and delete your account at any time. We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, with or without prior notice.

Upon termination, your right to use the App ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

12. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of New Jersey.
